Walloon-specific legal framework
Rent indexation in Wallonia is based on the Belgian Civil Code (amended in February 1994), the Walloon Decree of 15 March 2018 (Walloon Housing Code) and the 2022-2023 Walloon decrees. Key dates: 1 November 2022 (EPC link), 31 October 2023 (end of first period), 1 November 2023 (adjustments).

Conditions for indexation in Wallonia
- Written and registered lease. 2. Duration of at least one year since entry into force. 3. Indexation clause or primary residence lease. 4. Valid EPC certificate. For contracts concluded before 2018, the new EPC restrictions still apply. Written request to the tenant with the indices and the indexed rent.

Calculating indexation in Wallonia
Indexed rent = Base rent x (New index / Starting index) x EPC factor
Base rent (at the signing of the lease), health index for the month preceding the signing (starting index), index for the month preceding the anniversary (new index), EPC factor (0 to 1). The indexation calculation adjusts rents according to consumer prices and energy performance.

Wallonia indexation 2023 possible for EPC F?
No. Blocked at 0% from 1 November 2022.
Without EPC certificate?
Treated as EPC G. No indexation. Obtain the certificate before the anniversary date.
