What is a lease agreement?
A lease agreement sets the rules of the rental: rent, duration, rights and obligations of each party. A written lease is required for registration and enforceability against third parties.

Since the 2018 regionalization, each Belgian region has its own rental legislation.
Duration of a lease agreement
The lease duration varies by type:
- Primary residence lease: 9 years (standard duration).
- Short-term lease: 3 years maximum.
- Student lease: 12 renewable months.
- Long-term lease: more than 9 years.
- Commercial lease: 9 years minimum, renewable.
It is possible to sign a residential lease of 3, 6 or 9 years: the so-called 3-6-9 Belgian lease. The landlord can terminate at certain milestones, with notice.
Mandatory clauses in a lease agreement
A lease agreement in Belgium must contain several mandatory pieces of information:
- Full identity of landlord and tenant.
- Precise description of the rented property (address, area, number of rooms).
- Lease duration and start date.
- Rent amount and charges.
- Security deposit amount (maximum 3 months’ rent).
- Rules for annual rent indexation.
- Mandatory annexes: EPC, property inspection report, regional regulation.
Without these clauses, the lease can be contested before the justice of the peace.

Security deposit and rent amount
The security deposit protects the landlord in case of unpaid rent or damages. The amount may not exceed:
- 2 months’ rent if deposited in a blocked account in the tenant’s name.
- 3 months’ rent if financed through a free bank loan (some regions).
The lease must specify the chosen formula. The deposit is returned to the tenant at the end of the lease, if the property is returned in good condition.
