What is lease registration?

Lease registration is the act by which the State officially acknowledges the contract signed between landlord and tenant. Registration is done through the FPS Finance, which stores a digital copy of the contract.

The contract thus filed becomes a registered lease with a fixed date enforceable against third parties. This formality applies to all types of leases:

  • Primary residence lease
  • Non-primary residence lease
  • Student lease
  • Short-term lease
  • Commercial lease (different rules)

The signing date alone is not sufficient: it is the registration date that counts for enforcing the lease against third parties.

Why register your lease?

Registering your lease in Belgium protects both parties, but especially the landlord. Four main reasons:

  1. Legal obligation: the law requires registration within two months.
  2. Right to rent indexation: without registration, no rent indexation is possible.
  3. Enforceability against third parties: if the property is sold, the buyer must respect a registered lease.
  4. Proof of terms: the registered contract constitutes official evidence in case of dispute (rent amount, duration, inventory).

The tenant also benefits: they are protected in case of change of ownership and may invoke the rent amount stated in the registered contract.

Who must register and when?

The law designates the landlord as primarily responsible for registration. The deadline is strict: 2 months from the date the contract is signed.

But the tenant may also do it:

  • At any time after signing.
  • Free of charge, like the landlord for a primary residence lease.
  • Without the landlord’s explicit consent.

For leases other than the primary residence (second home, office, etc.), registration remains the landlord’s responsibility, with fees of 0.2% applicable.

How to register a lease in Belgium

There are three ways to register a lease:

The quickest method:

  1. Log in to myminfin.be with your identity card or itsme.
  2. Open the MyRent application.
  3. Upload the signed contract in PDF format.
  4. Add annexes (inventory of fixtures, EPC certificate).
  5. Submit and wait for the automatic acknowledgement of receipt.

Processing typically takes 24-48 business hours.

Option 2 — Registration office (in person)

Visit the competent registration office (by region) with the original signed contract, an identity document, and any annexes.

Option 3 — Registered letter

Send the contract by registered letter with acknowledgement of receipt.

Cost: free or paid?

The cost depends on the type of lease:

For a rent of 1,000 EUR per month over 9 years, the fees on a commercial lease amount to approximately 216 EUR (1,000 x 12 x 9 x 0.002).

The free registration of primary residence leases is an additional reason not to delay.

Registration of addenda

Any modification to the contract requires a lease addendum, which must also be registered.

A lease addendum is a document signed by both parties to amend a clause during the lease:

  • Change in rent amount (outside indexation)
  • Addition of a tenant (shared housing)
  • Extension of the lease
  • Change of duration

An addendum must follow the same procedure as the main contract:

  1. Draft the addendum in writing.
  2. Sign by both parties (landlord and tenant).
  3. Register with the FPS Finance within two months.

An unregistered addendum deprives the landlord of the effects of the modification.

Consequences of an unregistered lease

Failure to register deprives the landlord of several rights:

  • Inability to index the rent annually.
  • The tenant may leave without notice (termination at their own terms).
  • No enforceability if the property is sold.

How to check registration status

A registered lease automatically receives a registration number:

  1. Log in to MyMinfin with your identity card or itsme.
  2. Open the “My properties” or “MyRent” tab.
  3. Check the presence of the lease and its official registration date.

If the lease does not appear, it is not registered. The tenant may also check via their MyMinfin space.

Documents to attach

For a complete registration, ideally attach:

  • The signed lease in PDF format
  • The entry inventory of fixtures (if completed)
  • The EPC certificate for the rented property
  • Any mandatory annex depending on the region
