The residential lease in Belgium is governed by regional legislation. Brussels, Wallonia and Flanders each have their own rules since the regionalisation of housing.
By region
In Brussels, the Ordinance of 27 July 2017 governs residential leases. The rental deposit is capped at 2 months.
In Wallonia, the decree of 15 March 2018 applies. The deposit may reach 2 or 3 months depending on its form.
In Flanders, the Vlaams Woninghuurdecreet (2019) governs the lease. Maximum deposit: 3 months.
- Short-term lease (≤ 3 years)
- Nine-year lease (standard)
- Lifetime lease
Each type comes with its own termination and notice rules.
Pick the duration that fits your project and double-check your regional rules before signing.
