Address registration and residential lease in Belgium
Does the tenant have the right to register their address at the rented dwelling? Landlord's obligations, refusal of registration, tax and administrative consequences.
The right to register your address
In Belgium, address registration is a legal obligation (Act of 19 July 1991 on population registers). Anyone residing in a municipality must register there within 8 working days of moving in.
The landlord can never prohibit the tenant from registering at the rented property. A lease clause providing for such a prohibition is void by operation of law as contrary to public policy.
This means that even in a short-term lease or a student lease, the tenant has the right to register their address.
“The tenant is prohibited from registering their address at the leased premises” — this clause is void and without effect. If your lease contains it, it is simply disregarded by law.
Obligations of the parties
The tenant must:
- Report to the municipality within 8 days of moving in
- Provide an identity document and, if possible, a copy of the lease
- Be present during the neighbourhood officer’s check (within 15 days)
- Report any change of address when moving out
The landlord must:
- Not oppose the address registration
- Not demand the tenant’s removal from the register
- Tolerate the neighbourhood officer’s check (which verifies actual occupation)
The municipality must:
- Record the registration in the registers
- Send a neighbourhood officer for verification
- Issue a registration certificate if requested
Legal and tax consequences
For the qualification of the lease
Address registration establishes that the property is the tenant’s primary residence. This automatically triggers the protections of the primary residence lease:
- Minimum duration of 9 years (3-6-9)
- Free registration with the FPS Finance
- Protection in case of sale of the property
For taxation

Address registration determines the municipality of residence, which affects access to social benefits (CPAS/OCMW), moving allowances and social housing.
Special cases
Co-tenancy

Student accommodation
Students may register at their accommodation or remain registered at their parents’ home. In most cases, they stay registered at the family home unless they live there year-round.
Lease and reference address (homeless)
People without a fixed address may obtain a “reference address” from the CPAS/OCMW. This address allows registration in the registers without having accommodation.
