The mechanism of tacit renewal

Tacit renewal is the automatic renewal of the lease when neither party gives notice before the deadline. In Belgium, this mechanism applies to all primary residence leases.

The principle is simple: silence means consent. If neither the landlord nor the tenant expresses their intention to end the lease within the statutory deadlines, the lease continues as if the parties had signed a new contract.

The conditions of the renewed lease (rent, charges, clauses) remain identical to those of the initial lease. Only the annual rent indexation continues to apply normally.

3-6-9 lease renewal

At the 9-year deadline

If no notice is given at least 6 months before the end of the lease, it is renewed for 3 years under the same conditions. This renewal can repeat indefinitely: 9 years, then 3 years, then 3 years, then 3 years…

At triennial deadlines

The 3-6-9 lease offers termination options at each triennium (3, 6, 9 years). If the landlord does not give notice at these deadlines, the lease simply continues until the next deadline.

Short-term lease renewal

General rule

A short-term lease (less than 3 years) is renewed for an identical duration provided the total does not exceed 3 years.

Reclassification traps

If the renewal causes the total to exceed 3 years, the lease is automatically reclassified as a 9-year lease, retroactively from the start date of the initial lease.

Example:

  • 2-year lease signed on 01/01/2024
  • No notice given — renewed for 2 years — total = 4 years
  • Reclassification: the lease is considered a 9-year lease since 01/01/2024
Consequences of reclassification

Reclassification as a 9-year lease is irrevocable. The landlord can no longer invoke the short-term lease rules. The tenant benefits from all the protections of the 3-6-9 lease.

The landlord’s notice must be supported by grounds (personal occupation, works, without grounds with compensation). The tenant does not need to state grounds.

Practical tips

  1. Set a reminder 7 months before each deadline — this gives you time to decide and send the notice
  2. Check the lease type: 9-year lease or short-term lease — the renewal rules differ
  3. If you are a landlord and wish to recover the property, do not miss the deadline
  4. If you are a tenant and wish to stay, do nothing — renewal works in your favour
