Impact of address registration on the lease type

Address registration is a determining factor in qualifying the lease type. In Belgium, the primary residence lease depends not on the title of the contract but on the actual use of the property.

If the tenant registers at the property, three automatic legal consequences follow:

  1. The lease is classified as a primary residence lease (even if titled differently)
  2. Legal protections apply: 3-6-9 duration, notice periods, compensation
  3. Registration with the FPS Finance becomes free

This reclassification applies even if the contract is titled “ordinary law lease”, “occupation agreement” or “free lease”.

Address registration and property tax

Property tax is an annual regional tax on real estate. The tenant’s address registration may influence the amount in certain cases:

Some Belgian municipalities (particularly in Brussels) apply an empty property tax. The tenant’s address registration proves the property is occupied and avoids this surcharge.

Empty property surcharge

In Brussels, the empty property tax can reach EUR 500 per metre of facade per year. The tenant’s address registration is the simplest proof that the property is occupied.

Address registration vs lease registration

Address registration and lease registration are two distinct procedures that are often confused:

Both procedures are mandatory but one does not trigger the other. The tenant may be registered without the lease being registered, and vice versa.

Practical steps

For the tenant

  1. Before moving in: sign the lease and receive the keys
  2. Within 8 days: report to the municipality with your identity document and a copy of the lease
  3. Within 15 days: receive the visit of the neighbourhood officer confirming your presence
  4. After validation: receive your new identity card with the updated address

For the landlord

  1. Before signing: verify that the lease conforms to the lease type (primary residence)
  2. After signing: register the lease with the FPS Finance (MyRent)
  3. Do not block the tenant’s address registration
  4. Keep a copy of the registered lease
