What is the maximum lease duration in Belgium? Residential lease, commercial lease, ordinary-law lease: the legal limits by contract type.

Maximum duration by lease type

In Belgium, the maximum lease duration depends on the type of contract:

Belgian legislation does not set an absolute maximum duration for residential leases. In theory, a residential lease could be concluded for 20, 30 or even 50 years. In practice, leases exceeding 9 years are extremely rare.

Primary residence lease

The norm: 9 years

The standard duration for a primary residence lease is 9 years. This is the duration applied by default if the lease does not mention anything or mentions a duration between 3 and 9 years.

Beyond 9 years

The parties may agree on a longer duration (12, 15, 18 years…). In this case, the termination rules of the 3-6-9 lease apply with adaptations. The tenant retains the right to terminate at each triennial deadline.

Indefinite renewal

After 9 years, the lease is tacitly renewed for 3-year periods. In theory, a lease can last indefinitely through successive renewals. Consult our guide on tacit renewal.

In practice

A residential lease of more than 9 years is very rare. Landlords prefer the standard 3-6-9 lease or the short-term lease. Very long leases are reserved for specific situations (inheritance, family arrangements).

Commercial lease

9 years + 3 renewals

The commercial lease is concluded for a minimum of 9 years. The tenant has the right to 3 renewals of 9 years each, giving a maximum duration of 36 years.

Beyond 36 years

After the 3 renewals, the tenant no longer has an automatic right to renewal. They may negotiate a new lease, but the landlord is no longer bound.

In practice, many businesses occupy the same premises for decades thanks to successive renewals. The right to renewal is a strong protection for the commercial tenant.

Emphyteusis and ordinary law lease

Emphyteusis (15-99 years)

Emphyteusis is a real right that grants the leaseholder a quasi-ownership right over the property for a duration of 15 to 99 years. The leaseholder pays an annual canon and assumes full maintenance of the property, including property tax.

Emphyteusis is used primarily for unbuilt land, public property and tax structures.

Ordinary law lease (free duration)

The ordinary law lease (garages, offices, secondary residences) has no minimum or maximum statutory duration. The parties freely set the duration. An ordinary law lease may be concluded for 1 month or 30 years. It may also be concluded with open-ended duration.
