In Belgium

Hidden defects (vices caches / verborgen gebreken) refers to the plural form of hidden defect. For a detailed explanation of the legal framework, conditions and remedies under Belgian law, see the entry on hidden defect.

When a property presents multiple hidden defects simultaneously, the cumulative impact may justify more substantial remedies, including full judicial termination of the lease, even if each individual defect might not be sufficient on its own.

i
Good to know
When multiple hidden defects render a dwelling uninhabitable, regional housing inspectors (in Brussels, Wallonia or Flanders) can declare the property insalubrious. This can lead to a rental ban and strengthen the tenant’s position in court.

Practical example

A tenant discovers three hidden defects: faulty electrical wiring, a cracked sewer pipe causing odours, and asbestos in ceiling tiles. The cumulative effect renders the apartment unsafe. The justice of the peace pronounces judicial termination at the landlord’s expense and awards relocation costs.
