The Belgian winter truce specifically refers to the Brussels-Capital Region’s ordinance prohibiting enforcement of residential evictions between 1 November and 15 March. Wallonia and Flanders do not have equivalent legislation.
How it works
Scope. Applies to all residential evictions in Brussels regardless of grounds.
Court procedures continue. The justice of the peace can hear cases and render judgments during the truce. Only physical enforcement is suspended.
CPAS notification. The CPAS is notified of every eviction judgment to offer the tenant social assistance and rehousing support.
Practical example
An eviction judgment is rendered in October. The tenant does not vacate by 1 November. The bailiff cannot enforce until 16 March. The tenant remains for an additional 4.5 months without paying rent.
