An eviction order (ordonnance d’expulsion / uitzettingsbevel) is the formal court decision compelling a tenant to leave the rented property. It is issued by the justice of the peace and served by a bailiff.

How it works

Issuance. The justice of the peace renders a judgment ordering eviction and specifying a deadline (typically 1 month).

Enforcement. If the tenant does not vacate, the bailiff can enforce the order with police assistance: opening the door, inventorying belongings and handing the keys to the landlord.

Good to know
The tenant can appeal the eviction order, which may suspend enforcement. In practice, appeals in rental cases are rare when the grounds are clear.

Practical example

The justice of the peace orders a tenant in Liege to vacate within 1 month. The bailiff serves the order on 1 June. On 2 July, the bailiff returns with police and a locksmith. The tenant’s belongings are placed in storage. The landlord receives the keys.
