Eviction compensation (indemnite d’eviction / uitzettingsvergoeding) is a payment to a tenant evicted without fault. The rules differ between commercial and residential leases.

Commercial leases. The Commercial Lease Act provides for substantial compensation when the landlord refuses to renew: typically 1 to 3 years’ rent.

Residential leases. When a landlord terminates for personal occupation and fails to actually occupy within the prescribed period, the tenant is entitled to 18 months’ rent compensation.

A landlord who invokes personal occupation but does not move in within the prescribed period must pay 18 months’ rent compensation. This deters pretextual evictions.

Practical example

A landlord terminates a 9-year lease at year 6 for personal occupation but never moves in. The tenant sues and obtains 18 months’ rent compensation for fraudulent eviction.
