The lease addendum differs from the amendment: the amendment modifies existing clauses, while the addendum adds new provisions without touching the original content. In practice, the two terms are often used interchangeably.
Common situations for an addendum:
- Adding a clause on pets
- Adding specific house rules
- Clarifying the use of garden, parking or cellar
- Adding an agreement on tenant works
The addendum must be written, signed by landlord and tenant, and registered with FPS Finance.
Practical example
After 6 months of tenancy, the tenant wishes to set up a vegetable garden in the communal garden. The landlord agrees and an addendum is drafted: it authorises the use of 10 m2 of garden for the vegetable patch, provides for restoration at departure, and specifies that the tenant bears the costs.
