The general framework

In Belgium, a tenant under a 9-year lease can terminate at any time with 3 months’ notice. However, if they leave during the first three years, they must pay compensation to the landlord.

The compensation is degressive: 3 months’ rent in the first year, 2 months in the second, 1 month in the third. From the fourth year onwards, no compensation is due.

Regional differences

Note: since the regionalisation of housing leases, each region has its own nuances. In Brussels, the Brussels Housing Code provides specific provisions for short-term leases. In Flanders, the Vlaams Woninghuurdecreet introduces slightly different rules for student leases.
