A lease agreement formalizes the rental of a property between a landlord and a tenant. It sets the rules: rent, duration, rights and obligations. In Belgium, leases are governed by the Civil Code and regional decrees.

The main Belgian lease types are: primary residence lease (9 years), student lease (12 months), short-term lease (3 years max), long-term lease (over 9 years), shared housing lease and commercial lease (9 years minimum).

The standard duration for a primary residence lease is 9 years. There are also 3 or 6-year leases (3-6-9 lease). Short-term leases cannot exceed 3 years. Student leases typically last 12 renewable months.

Yes. Registering the lease with FPS Finance is mandatory in Belgium. It is free and must be done by the landlord within 2 months of signing. Three options: MyRent online, registered mail or local registration office.

The security deposit is limited to 2 months' rent if deposited in a blocked account in the tenant's name, or 3 months' rent if financed through a free bank loan (depending on the region).

The tenant can terminate at any time with 3 months’ notice (primary residence lease). The landlord can terminate with 6 months’ notice, with a valid reason (personal occupation, renovation, end of term).
