Lease registration in Flanders rests on two legislative levels:

  • Federal: the registration procedure is a federal formality. The FPS Finance receives a copy of the contract via MyRent, regardless of the region where the property is located.
  • Regional: the content of the primary residence lease in Flanders is governed by the Vlaams Woninghuurdecreet (Flemish Housing Lease Decree), in force since 1 January 2019.

This decree replaces the former Civil Code provisions for Flemish residential leases. It sets the rules on lease duration, notice periods, charges, inventory of fixtures and consequences of non-registration.

Registration procedure in Flanders

The procedure is identical to that in the other regions:

  1. Log in to myminfin.be with your identity card or itsme.
  2. Open the MyRent application (available in Dutch: “Huurcontract registreren”).
  3. Upload the signed contract in PDF format.
  4. Attach the annexes: inventory of fixtures, EPC certificate (EPC in Dutch).
  5. Submit — confirmation receipt within 24-48 business hours.

Registration office

The FPS Finance has regional offices across Flanders (Antwerp, Ghent, Bruges, Leuven, Hasselt). Physical submission remains possible for complex cases.

Registered post

The contract may be sent by registered mail to the competent registration office.

The legal deadline is 2 months after signing. Registration is free for a primary residence lease.

Flemish specifics

The Vlaams Woninghuurdecreet introduces several particularities that affect registration and its consequences:

Language of the lease

For a property located in Flanders, the language decree requires the use of Dutch in dealings between the landlord and Flemish authorities. The lease may be drafted in French between private parties, but the tenant may demand a Dutch version.

Mandatory inventory of fixtures

The Flemish decree requires a detailed move-in inventory of fixtures, to be attached as an annex to the lease at registration. This inventory must be drawn up jointly by the parties or by an expert.

Rental guarantee cap

The Flemish rental guarantee is capped at a maximum of 3 months’ rent. This amount is stated in the registered lease.

Mandatory EPC

The energy performance certificate (EPC — Energieprestatiecertificaat) is mandatory before letting and must be annexed to the lease. The energy label must appear in the listing and in the contract.

Unregistered lease in Flanders

Non-registration of a lease in Flanders entails the same consequences as in other regions, with reinforced tenant protection:

  • No indexation: the landlord loses the right to index the rent for as long as the lease remains unregistered.
  • Termination without notice: the Flemish tenant may terminate the lease without observing any notice period and without paying compensation if the lease is not registered. This is the most severe consequence for the landlord.
  • Unenforceability: in the event of a property sale, the buyer is not bound by an unregistered lease.

Article 11 of the Vlaams Woninghuurdecreet expressly enshrines the tenant’s right to freely terminate an unregistered lease.

Regularising an unregistered Flemish lease

Regularisation is possible at any time, even several years after signing:

  • Free for a primary residence lease or a student lease.
  • Same procedure: via MyRent, registration office or registered post.
  • Immediate effect: from the moment of registration, the landlord regains the right to index the rent and the lease becomes enforceable against third parties.

Indexations missed during the period of non-registration cannot be claimed retroactively. It is therefore in the landlord’s interest to register the lease as quickly as possible.
