In Brussels, lease registration is a federal competence (FPS Finance), but the content of the lease is governed by the Brussels Housing Code since 2017. This means:

  • The registration procedure is the same as in Wallonia or Flanders.
  • The mandatory lease clauses follow the Brussels Housing Code (annexes, inventory of fixtures, Brussels EPC).
  • The standard duration remains the 9-year lease, with possible variants (short-term lease, student lease).

Who must register the lease in Brussels?

Both the landlord and the tenant are entitled to register, but the primary obligation falls on the landlord:

  • Landlord: legal obligation, deadline of 2 months after signing.
  • Tenant: may register at any time if the landlord delays.

For a primary residence lease in Brussels, registration is free. For other residential leases (second residence), a fee of 0.2% applies.

How to register a lease in Brussels?

Three routes are available, all through the FPS Finance:

Route 1 — MyRent (online)

  1. Log in to myminfin.be with your identity card or itsme.
  2. Open the MyRent application.
  3. Upload the contract in PDF format.
  4. Add the mandatory annexes (Brussels EPC, inventory of fixtures).
  5. Submit and keep the confirmation receipt.

This is the fastest and recommended method: processing within 24-48 business hours.

Route 2 — Brussels registration office

Bring the original signed contract, identity documents and the annexes (inventory of fixtures, EPC) to the relevant office.

Route 3 — Registered post

A legal alternative for those who prefer paper. Send the documents to the competent registration office by registered mail.

Brussels-specific requirements for registration

When registering a lease in Brussels, ideally attach:

  • Inventory of fixtures at move-in: strongly recommended, often mandatory.
  • Brussels EPC certificate: required for future indexation.
  • Mandatory annexes: general conditions, rights and obligations.
  • Proof of rental guarantee deposit if applicable.

The rent amount and the number of months of rental guarantee are stated in the contract. Registration gives them a certified date enforceable against third parties.

If you let your property through an agency, verify that the lease has been registered by them. The legal responsibility remains with the landlord.

Consequences of an unregistered lease in Brussels

Non-registration deprives the landlord of several essential rights:

  • No annual rent indexation.
  • The tenant may terminate the lease without a long notice period.
  • The lease is not enforceable in the event of a property sale.
  • In case of unpaid rent, difficulty issuing an effective formal notice.

Regularising an unregistered Brussels lease

Registering a contract late is not an irreparable fault:

  1. Gather the signed contract and annexes.
  2. Go to MyRent or the registration office.
  3. Attach all up-to-date documents.
  4. Keep the confirmation receipt.

Regularisation remains free for a primary residence lease, even several years after signing. However, it does not allow recovery of past indexations (no retroactive effect).
