Uninhabitable or unhealthy property: tenant remedies
What if your rental is uninhabitable or unhealthy? Remedies in Belgium.
Definition and criteria of uninhabitability
An uninhabitable property does not meet the minimum standards set by Belgian Regions in terms of safety, sanitation and habitability.
Uninhabitability criteria

Tenant rights
What the tenant can demand
- The landlord to bring the property into compliance
- A rent reduction proportional to the loss of enjoyment
- Termination of the lease without compensation if the property is uninhabitable
- Damages if there is harm (health, belongings)
What the tenant cannot do
- Unilaterally suspend rent payment
- Leave the property without notice or court decision
- Carry out compliance works at the landlord’s expense (without agreement or court decision)
Remedy procedure
Step 1: formal notice
Send a registered letter to the landlord:
- Describe the defects found (photographs, description)
- Recall their legal obligations
- Set a reasonable repair deadline (15-30 days)
Step 2: report to the regional service
If the landlord does not act, report to the regional service:
- Brussels: Regional Housing Inspectorate
- Wallonia: SPW Logement
- Flanders: Wooninspectie
Step 3: justice of the peace
Refer to the justice of the peace to:
- Order compliance works
- Obtain a rent reduction
- Obtain termination of the lease without compensation
- Obtain damages
Step 4: mayor’s order (emergency)
In case of imminent danger, the mayor can issue an uninhabitability order that requires evacuation and terminates the lease by operation of law.
