What is a hidden defect in a rental property
A hidden defect is a defect that was not apparent at the time of the entry property inventory and that existed before or at the time the lease was signed.

The landlord is liable for hidden defects even if they were unaware of them (article 1721 of the Civil Code). The rental deposit does not cover hidden defects.

Evidence required
The tenant must prove:
- The existence of the defect
- The hidden nature (not visible at entry)
- Pre-existence (existed before entry)
- The severity (impact on enjoyment)
Key evidence: expert report, bailiff’s record, photos, testimonies. An expertise is often necessary.
Procedure in case of a hidden defect
Step 1: record and document
As soon as the defect is discovered, take photos, call an expert if necessary and inform the landlord in writing.
Step 2: formal notice
Send a formal notice by registered mail requesting repair within a reasonable timeframe.
Step 3: justice of the peace
If the landlord does not respond, bring the matter before the justice of the peace. The court will likely order a judicial expertise to determine the nature, pre-existence and repair cost of the defect.
[!warn] Warning Act promptly after discovery. Excessive delay may be interpreted as acceptance of the defect or make it harder to prove pre-existence.
Protecting yourself against hidden defects
As a tenant: carry out a very detailed entry property inventory and report any defect discovered afterwards. As a landlord: carry out a full diagnostic before putting the property on the market.
Consult the rental disputes guide and document everything with a rental management software. Create a lease that does not contain a hidden defects exclusion clause (these are void for residential leases).
