Formal notice for rental matters: how to draft it correctly
How to draft a formal notice in rental matters: mandatory content, template, sending and legal consequences in Belgium.
Role and purpose of a formal notice
A formal notice is a formal letter requesting the other party to comply with their obligations. It is the first formal step in resolving a rental dispute.
| Function | Effect |
|---|---|
| Proof of good faith | The court sees that you attempted an amicable solution |
| Triggers deadlines | Late interest runs from the formal notice |
| Pressure | The other party becomes aware of the seriousness |
| Evidence | Useful document before the justice of the peace |
The formal notice is used in all types of disputes: unpaid rent, repairs not carried out, release of rental deposit, nuisances.

How to send the formal notice
Registered letter with acknowledgement of receipt
A registered letter is the only method that guarantees proof of dispatch and receipt. Keep:
- A copy of the letter
- The postal receipt
- The signed acknowledgement of receipt
Complementary alternatives
Also send the same text by email for speed, but the registered letter remains essential. A bailiff’s record can also serve as a formal notice (more expensive but more solemn).
[!important] Legal point If the recipient refuses the registered letter, the formal notice is considered validly sent. Refusal of receipt does not block the proceedings.
Centralise the dispatch and tracking of your formal notices with a rental management software.
After the formal notice: what to do
If the formal notice remains unanswered after the deadline, move to the next step: conciliation (free) or summons before the justice of the peace.
Consult the rental disputes guide for the rest of the procedure. Protect yourself from the outset with a well-drafted lease.
