Role and purpose of a formal notice

A formal notice is a formal letter requesting the other party to comply with their obligations. It is the first formal step in resolving a rental dispute.

How to send the formal notice

Registered letter with acknowledgement of receipt

A registered letter is the only method that guarantees proof of dispatch and receipt. Keep:

  • A copy of the letter
  • The postal receipt
  • The signed acknowledgement of receipt

Complementary alternatives

Also send the same text by email for speed, but the registered letter remains essential. A bailiff’s record can also serve as a formal notice (more expensive but more solemn).

[!important] Legal point If the recipient refuses the registered letter, the formal notice is considered validly sent. Refusal of receipt does not block the proceedings.
