Rent control in Belgium is a recurring political topic, but the legal reality remains a flexible and indicative system. Unlike Paris (strict cap) or Berlin, Belgium imposes no legal ceiling on initial private rent.

The existing tools:

  • The indicative rent grid: non-binding reference range (Brussels and Wallonia)
  • The triennial review: possibility to adjust rent to market value every 3 years
  • Indexation: annual adjustment to the cost of living, capped by the health index
  • Social housing: only sector with truly capped rents

The Belgian principle is contractual freedom for setting the initial rent.

Between tenants, the landlord can freely set a new rent — the only moment without constraints. This is why some landlords prefer short leases to readjust rent to the market.

Practical example

A landlord rents at 850 EUR/month for 6 years. The market has moved to 1,050 EUR for similar properties. They cannot simply raise to 1,050 EUR. Options: triennial review (if +20% justified), or wait for the lease end to set 1,050 EUR for the next tenant.
