The indexation deferral is a specific measure of the Brussels-Capital Region, introduced progressively since November 2022. It deprives landlords whose property has a poor EPC label of the right to index the rent.

Brussels rules:

In Wallonia and Flanders, no indexation deferral linked to EPC exists yet, though similar measures are under discussion.

The goal is to incentivise owners of energy-inefficient properties to invest in energy renovation. Once the property obtains a better EPC label (after works and new certificate), the right to index is restored.

Warning
A Brussels landlord who indexes despite an EPC E, F or G label risks challenge by the tenant and reimbursement of amounts unduly collected. Check the EPC label before any indexation request.

Practical example

An apartment in Ixelles with EPC F. The landlord cannot index the 850 EUR rent since November 2022. After 3 years without indexation, the cumulative loss compared to an indexable property is approximately 80 EUR/month, i.e. 960 EUR/year. Investing 12,000 EUR in insulation would restore the indexation right.
