Rent review is distinct from indexation. Indexation adjusts rent to the cost of living; the review modifies the base rent to match market value. Two strict conditions:

  • Time window: between the 9th and 6th month before each triennial end
  • Variation threshold: rental value must have changed by at least 20%

How it works

Amicable. Request by registered letter with desired amount and justification. If agreed, lease amendment signed.

Judicial. If disagreement, the justice of the peace decides. An expert typically assesses the rental value.

Good to know
The new base rent set by the review becomes the reference for future indexations. It is a reset — previous indexations no longer apply to the new amount.

Practical example

Pierre rents in Brussels for 6 years. Base rent 750 EUR, indexed to 815 EUR. Similar properties now rent at 950-1,000 EUR (+20%). He files a review request. The judge sets the new base at 940 EUR.
