The formal notice is the formal step preceding legal action. It has three functions:
- Legal: it constitutes proof that you gave the tenant a final deadline to pay
- Deterrent: the formal tone and mention of legal action encourages payment
- Evidentiary: before the justice of the peace, it demonstrates your good faith and patience
It is generally the last attempt at amicable resolution before court.
Our template includes all required elements:
- Full identification of landlord and tenant
- Reference to the lease (date, address, registration number)
- Precise breakdown of amounts owed (rent, charges, late interest)
- Reminder of previous reminders (dates)
- Payment deadline granted (15 days)
- Explicit mention of consequences if unpaid (legal action, lease termination request, damages)
- Accepted payment method (account number)
Mandatory sending method: registered letter with acknowledgement of receipt
- Keep proof of sending (postal receipt)
- Note the date of first presentation at the tenant’s address
- The 15-day deadline runs from first presentation (even if not collected)
Via LeaseBelgium: you can send your registered letter directly from the platform, without going to the post office. Tracking is automatic.
If the tenant does not pay within the deadline:
| Step | Action | Timeline |
|---|---|---|
| Conciliation | Request to justice of the peace | 2-4 weeks |
| Summons | Leaseiff summons the tenant | 2-6 weeks |
| Hearing | Judgment | 4-8 weeks |
| Enforcement | Seizure or eviction | Variable |
Recommendation: try conciliation at the justice of the peace first. It is free, quick, and often sufficient to unblock the situation.
