Renting in a flood zone in Belgium: obligations
Renting a property in a flood zone in Belgium. Information obligations, insurance, lease, and responsibility of landlord and tenant.
Landlord’s information obligations
In Belgium, the landlord of a property located in a flood zone has specific information obligations before letting the property.
By Region
| Region | Obligation | Medium |
|---|---|---|
| Wallonia | Mandatory mention of flood risk level | Advertisement + lease |
| Brussels | Information on known risks | Lease |
| Flanders | Watertoets (flood score) | Advertisement + lease |
Risk mapping
Each Region has an official flood zone map. The landlord must check their property’s situation before any letting. Non-compliance with the information obligation may result in lease nullity or a rent reduction. See our guide on the landlord’s obligations.
Insurance and coverage
Mandatory coverage
Since the law of 17 September 2005, all fire insurance must cover natural disasters, including floods. This coverage is automatic and cannot be excluded.
Premiums in risk zones
| Zone | Impact on premium |
|---|---|
| Low-risk zone | Standard premium |
| Medium-risk zone | Possible surcharge |
| High-risk zone | Significant surcharge |
| Red zone (non-buildable) | Insurance difficult to obtain |
Deductible
The deductible for flood claims is generally higher than for standard insurance. Check the conditions of your home insurance policy.
Even though flood coverage is mandatory, insured amounts and deductibles vary between policies. Compare offers before signing.
Impact on the lease
Before signing
The landlord must provide all flood risk information before the lease is signed. Failure to inform may constitute a defect of consent.
During the lease
If a flood occurs: the landlord repairs structural damage, the tenant takes urgent protective measures, insurance intervenes according to the guarantees taken out.
Termination after an incident
In case of a major flood:
| Damage | Tenant’s right |
|---|---|
| Dwelling totally uninhabitable | Automatic lease termination |
| Significant damage | Choice: rent reduction or termination |
| Minor damage | Repair by the landlord |
| For termination procedures, see our guide on the lease and contract. |
