In Belgium, the landlord of a property located in a flood zone has specific information obligations before letting the property.

Insurance and coverage

Mandatory coverage

Since the law of 17 September 2005, all fire insurance must cover natural disasters, including floods. This coverage is automatic and cannot be excluded.

Deductible

Impact on the lease

Before signing

The landlord must provide all flood risk information before the lease is signed. Failure to inform may constitute a defect of consent.

During the lease

If a flood occurs: the landlord repairs structural damage, the tenant takes urgent protective measures, insurance intervenes according to the guarantees taken out.

  • Yes. The landlord has a prior information obligation. In Wallonia, the flood risk level must appear in the advertisement and the lease. Non-compliance may lead to the nullity of the lease.

  • Yes, fire insurance mandatorily covers natural disasters (including floods) since 2005. However, premiums may be increased in high-risk zones.

  • If the flood renders the dwelling uninhabitable, the tenant can request the termination of the lease or a rent reduction. In case of partial damage, the choice belongs to the tenant.
