Unfit dwelling: rights and remedies in Belgium
Unfit dwelling in Belgium: definition, standards by region, tenant remedies, landlord obligations and proceedings before the justice of the peace.
Definition and sanitary standards by region
Each Belgian region has its own minimum sanitary standards:
| Criterion | Brussels | Wallonia | Flanders |
|---|---|---|---|
| Reference text | Brussels Housing Code | Walloon Sustainable Housing Code | Vlaamse Wooncode |
| Inspection body | Regional Inspection Directorate | Municipalities + administration | Wonen-Vlaanderen |
| Sanction | Rental prohibition | Prohibition + fine | Ongeschikt/onbewoonbaar |
| Rental permit | No | Yes (certain dwellings) | Conformity certificate (some municipalities) |
The standards cover: structural stability, waterproofing, electricity, heating, ventilation, natural lighting, sanitary facilities and minimum floor area.
Tenant remedies
Step 1: formal notice
Send a registered letter to the landlord detailing the problems and requesting repairs within a reasonable timeframe (15-30 days). Consult our guide on formal notices.
Step 2: administrative report
Report the dwelling to the municipality or regional inspection service. An inspector will visit the dwelling and draft a report.
Step 3: justice of the peace
If the landlord does not respond, bring the matter before the justice of the peace. You can request:
| Request | Effect |
|---|---|
| Order to carry out repairs | Obligation to repair + penalty payment |
| Rent reduction | Rent reduced proportionally |
| Lease termination | Termination at the landlord’s fault |
| Damages | Compensation for the harm suffered |
Keep all evidence: photos, correspondence, medical reports if your health has been affected.
Landlord obligations
The landlord has a legal obligation to deliver a dwelling that meets sanitary standards and to maintain it throughout the duration of the lease. This is an obligation of result, not of means.
| Obligation | Legal basis |
|---|---|
| Deliver a habitable dwelling | Article 1719 of the Civil Code |
| Maintain in good condition | Article 1720 of the Civil Code |
| Carry out major repairs | Article 1720 of the Civil Code |
| Comply with regional standards | Regional housing codes |
[!warn] Warning A landlord who knowingly rents an unsanitary dwelling commits a criminal offence punishable by fines (up to 25,000 EUR) and imprisonment in serious cases.
