The professional lease occupies a grey area in Belgian rental law. It is covered neither by the protective rules of the primary residence lease (no 9-year minimum, no eviction protection) nor by the Act of 30 April 1951 on commercial leases (no right of renewal, no eviction compensation).

It typically applies to:

  • Medical, dental, veterinary practices
  • Law firms, accountants, architects
  • Offices for consultants, coaches, therapists

Duration, rent, termination conditions and charges are freely negotiated between the parties. The contract falls under general lease law (Articles 1714 onwards of the Civil Code).

Good to know
If a liberal professional receives clients in their premises (direct contact with the public), the lease could be reclassified as a commercial lease. The distinction depends on the actual activity, not the label chosen by the parties.

Practical example

A lawyer rents an office in Brussels for 1,200 EUR/month with a 6-year professional lease. At expiry, the landlord decides not to renew — they have no obligation to do so. The lawyer must vacate within the notice period agreed in the contract. No eviction compensation is due.
