Why a specific student template?

A standard rental agreement does not cover all the specificities of a student lease:

  • 12-month duration aligned with the academic year.
  • Proof of enrolment at a higher education institution required.
  • Explicit mention of “student lease” in the contract.
  • 2-month notice period (Wallonia) or 3-month notice period (Brussels / Flanders).
  • Possible termination without notice or compensation at the end of the academic year (Wallonia).

A generic template could risk reclassification as a standard primary residence lease (9 years).

What the template contains

All mandatory mentions:

  • Full identity of the landlord and the student.
  • Exact address of the property (room, studio, student accommodation).
  • Precise duration with signing date and end date.
  • Rent amount and payment terms.
  • Security deposit (2 months WAL, 3 months BXL/FLA).
  • EPC certificate with energy class.
  • Proof of enrolment to be annexed.
  • Explicit mention of “student lease”.
  • Adapted termination clauses.

Regional specificities

The template adapts to all three regions. In Brussels, the deposit can go up to 3 months and the document may be drafted in French or Dutch. Wallonia stays at 2 months and requires a co-tenancy agreement if there are multiple students. Flanders follows the Woninghuurdecreet (Housing Rental Decree).

How to use the template

5 steps:

  4. Sign by all parties with the mention “Read and approved”.

Student lease registration

Registration is mandatory within 2 months of signing. Free via MyRent (FPS Finance). Without registration, the student can leave without notice or compensation. Each amendment must also be registered.

Amendment included as annex

An amendment template is provided. It is used to modify the ongoing lease: rent revision, addition of a co-tenant, extension, change of use.

The amendment must be signed by all parties and registered if the original lease was.

Termination and early ending

To end the student lease:

  • By the student: 2-month notice (WAL) or 3-month notice (BXL/FLA) by registered letter. No compensation at the end of the academic year with proof (Wallonia).
  • By the landlord: 6-month notice at the end of the term, legal grounds required.
  • By mutual agreement: written agreement signed at any time.
