Lead in a rental property in Belgium: obligations
Landlord's obligations regarding lead in a rental property in Belgium. Assessment, works, health risks, and tenant's rights.
Health risks of lead in a dwelling
Lead is present in many older Belgian dwellings, mainly in paints (buildings before 1970) and pipes (buildings before 1960). Lead exposure can cause lead poisoning (saturnism).
Sources of lead in a dwelling
| Source | Buildings concerned | Risk |
|---|---|---|
| Lead paint | Before 1970 | High if degraded |
| Lead pipes | Before 1960 | High (drinking water) |
| Lead solder | Before 1990 | Medium |
| Stained glass and fittings | Old | Low |
At-risk populations
Children under 6 and pregnant women are particularly vulnerable. The landlord should be vigilant when renting to a family with children.
Landlord’s obligations
General habitability obligation
The landlord must deliver a dwelling meeting habitability standards (Civil Code and regional decrees). A dwelling containing accessible lead is non-compliant.
By Region
| Region | Regulation | Specific lead obligation |
|---|---|---|
| Brussels | Brussels Housing Code | Habitability standards including lead |
| Wallonia | Walloon Sustainable Housing Code | Inspection during rental permit |
| Flanders | Vlaams Woondecreet | Compliance standards |
Information obligation
If the landlord knows of the presence of lead (pipes, paints), they must inform the tenant. Failure to inform may engage their liability in case of health problems. For general obligations, see our guide on the landlord’s obligations.
Compliance works
Lead pipes
Replacing lead pipes is a major repair at the landlord’s expense:
| Intervention | Indicative cost | Timeframe |
|---|---|---|
| Internal pipe replacement | 2,000 - 5,000 EUR | 2-5 days |
| Network connection | Variable (operator) | 2-4 weeks |
| Water analysis | 50 - 150 EUR | 1-2 weeks |
Lead paint
Lead paint must be treated if degraded (flaking, powdery). Two options: encapsulation (covering the lead paint, less costly) or stripping (removing the paint, safer but more costly). Stripping must be carried out by a qualified professional to prevent lead dust dispersion. For the tax aspects of works, see our guide on rental taxation.
Tenant’s remedies
In case of proven danger
- Report the problem to the landlord by registered letter
- Request a water analysis or paint assessment
- If the landlord does not act, report to the regional housing service
- Refer to the justice of the peace to demand works or a rent reduction
Rent reduction
If the presence of lead reduces the enjoyment of the dwelling (inability to drink tap water, inaccessible rooms), the tenant may request a proportional rent reduction.
Damages
In case of health problems linked to lead, the tenant may engage the landlord’s liability and claim damages. To formalise your steps, see our guides on tenant’s rights and the property inventory.
Frequently asked questions
-
There is no mandatory systematic lead assessment in Belgium for private dwellings. However, the landlord has a general obligation to deliver a healthy dwelling that does not pose a health risk.
-
The landlord bears the cost of replacing lead pipes (major repair). Replacement of public pipes is the responsibility of the water network operator.
-
Lead causes lead poisoning (saturnism), particularly dangerous for children and pregnant women. Sources of exposure in dwellings are lead paint and lead pipes.
