Health risks of lead in a dwelling

Lead is present in many older Belgian dwellings, mainly in paints (buildings before 1970) and pipes (buildings before 1960). Lead exposure can cause lead poisoning (saturnism).

Children under 6 and pregnant women are particularly vulnerable. The landlord should be vigilant when renting to a family with children.

General habitability obligation

The landlord must deliver a dwelling meeting habitability standards (Civil Code and regional decrees). A dwelling containing accessible lead is non-compliant.

Information obligation

Replacing lead pipes is a major repair at the landlord’s expense:

Lead paint

Lead paint must be treated if degraded (flaking, powdery). Two options: encapsulation (covering the lead paint, less costly) or stripping (removing the paint, safer but more costly). Tenant’s remedies

In case of proven danger

  1. Report the problem to the landlord by registered letter
  2. Request a water analysis or paint assessment
  3. If the landlord does not act, report to the regional housing service
  4. Refer to the justice of the peace to demand works or a rent reduction

Rent reduction

If the presence of lead reduces the enjoyment of the dwelling (inability to drink tap water, inaccessible rooms), the tenant may request a proportional rent reduction.

  • There is no mandatory systematic lead assessment in Belgium for private dwellings. However, the landlord has a general obligation to deliver a healthy dwelling that does not pose a health risk.

  • The landlord bears the cost of replacing lead pipes (major repair). Replacement of public pipes is the responsibility of the water network operator.

  • Lead causes lead poisoning (saturnism), particularly dangerous for children and pregnant women. Sources of exposure in dwellings are lead paint and lead pipes.
