Tenant civil liability: the principle

Tenant civil liability (RC) is the legal obligation to compensate damage caused to third parties. In a rental context, this includes damage to the rented property (tenant liability) and damage to neighbours (civil liability towards third parties).

In Belgian law, the tenant is presumed liable for damage occurring during the lease (Article 1733 of the Civil Code). This means the tenant must prove they are not at fault — otherwise, they are responsible.

The tenant’s civil liability is typically included in the home insurance policy (multirisque). It is not a separate product — it is a guarantee within the comprehensive policy.

What tenant liability covers

Tenant liability (towards the landlord)

  • Fire damage to the building
  • Water damage to the structure
  • Explosion damage
  • Damage from negligent use

Civil liability (towards third parties)

  • Water damage to neighbours (leak from your flat)
  • Fire spreading to adjacent properties
  • Falling objects from your balcony
  • Damage caused by your children or pets

Civil liability and co-ownership

In a co-ownership building, tenant liability is particularly important:

  • A water leak from your flat can damage multiple units below
  • A fire can affect the entire building structure
  • Damage to common areas (stairs, lift, entrance) may be your responsibility

The co-ownership has its own insurance (covering common areas and the building structure), but it exercises recourse against the responsible party. If you are the cause, your civil liability insurance covers the recourse.

Without insurance, you would pay out of pocket for damage that can easily reach EUR 10,000-50,000 per affected neighbour.

How to subscribe

Tenant civil liability is included in standard home insurance (multirisque) policies. You do not need a separate policy.

When subscribing to home insurance:

  1. Verify the civil liability amount: EUR 5,000,000 minimum, EUR 10,000,000 recommended
  2. Check third-party coverage: confirm damage to neighbours is covered
  3. Review exclusions: some policies exclude certain types of water damage or damage by pets
  4. Provide the certificate: the landlord may request proof of civil liability coverage

Cost: included in the overall home insurance premium (EUR 90-300/year). No additional cost for the civil liability guarantee.
