Standing order

What it is

A standing order is an automatic transfer programmed by the tenant with their bank. The rent is debited automatically each month.

Which clause to insert in the lease

Insert a clause specifying the payment method: “The rent is payable by bank transfer to the landlord’s IBAN account [number], with the structured communication [reference].”

  • Not by law, but the lease can require a specific payment method. If the lease specifies bank transfer, the tenant must comply. Without a specific clause, the tenant can pay by any legal means (transfer, cash under EUR 3,000, cheque).

  • No, a standing order is not mandatory. The lease may recommend it but cannot impose it. The tenant remains free to choose between manual transfer and standing order.

  • If the lease requires bank transfer, the tenant's refusal is a contractual breach. The landlord can send a reminder by post. If the lease says nothing, the landlord cannot refuse a cash payment (under EUR 3,000).
