Termination does not take immediate effect
No, you cannot leave a property and stop paying rent on the same day you terminate. The lease only ends after a 3-month notice period. You can physically move out immediately, but rent remains due for the full 3 months. The only way to leave without a notice period is a mutual termination agreement signed by both parties.
The sequence is:
- Send a registered letter giving notice
- Wait for the notice period to start (1st of the following month after receipt)
- The lease continues for 3 full months
- Rent is due for the entire period
- The lease ends on the last day of the 3rd month
Moving out early does not shorten the notice or reduce the amount owed.

Leaving immediately without respecting the notice period does not save money. You will owe 3 months of rent regardless. In the first 3 years, add the early termination compensation (1-3 months). Total cost can reach 4 to 6 months of rent if you leave in the first year.
Mutual termination: the only exception
The only way to terminate a lease with immediate effect is mutual termination (resiliation d’un commun accord):
- Both parties sign a written agreement specifying the termination date
- The agreement can set any date, including the same day
- No notice period is required
- No compensation is required (unless agreed)
- The agreement should address the deposit, exit inventory, and final charges
Mutual termination is particularly useful when:
- A new tenant is already lined up
- The property needs immediate renovation
- Both parties agree that an early end benefits everyone
Regional specifics
Brussels-Capital Region
The Ordinance of 27 July 2017 does not provide for immediate termination. The 3-month notice period applies.
Wallonia
The Decree of 15 March 2018 applies the same rules. No immediate termination without mutual agreement.
Flanders
The Flemish Housing Rental Decree of 9 November 2018 confirms the 3-month notice requirement. Mutual termination is possible under the same conditions.
