Mandatory clauses and annexes

A valid lease in Belgium must contain several mandatory clauses:

  • Identity of the landlord and the tenant.
  • Detailed description of the rented property.
  • Lease duration and start date.
  • Rent amount and service charges.
  • Amount of the security deposit.
  • Rent indexation rules.

Mandatory annexes are also regulated by law. Depending on your region, you must include:

  • The EPC certificate.
  • The entry inventory of fixtures.
  • The list of major repairs the landlord is responsible for.
  • Regional explanatory annexes (Wallonia, Brussels, Flanders).

Registering your lease after creation

Once the contract is signed, it must be registered. This process is free, mandatory and the landlord’s responsibility.

You have two months after the date the lease is signed to register your contract with FPS Finance. Three options:

  • Online via the MyRent platform.
  • By registered mail to the competent office.
  • At the local registration office.

Registration protects both parties. The tenant is protected against early eviction. The landlord has a certified date, enforceable against third parties in the event of a sale or dispute.

Signing your lease: electronic or handwritten?

Two options to sign a lease in Belgium:

  • Handwritten signature: each party signs on paper, at the bottom of the contract.
  • Electronic signature: remote signing via itsme or email code.

An electronic signature has the same legal value as a handwritten signature. It is governed by the European eIDAS regulation. Once the lease is signed, each party receives an electronically signed and timestamped copy.

Landlord and tenant can sign the lease online in a matter of seconds, from their sofa. No need for appointments.

Terminating the lease

Before even creating a lease online, consider the exit rules. Depending on the lease type, the conditions for ending the contract vary:

  • Tenant’s notice: generally three months.
  • Landlord’s notice: subject to conditions (personal occupation, renovation works, end of term).
  • Early termination compensation.
