Amicable termination allows ending a lease without going through legal notice procedures. It is useful when:
- The tenant needs to leave before the lease expires and the landlord agrees
- The landlord wants the property back and the tenant agrees to leave
- Both parties want to fundamentally change conditions (new lease)
- A dispute is settled through a negotiated departure agreement
It is the quickest and least expensive solution for both parties.
Our template automatically generates:
- Identification of the parties (landlord and tenant)
- Reference to the original lease (date, address, duration)
- Effective end date of the lease
- Financial conditions (any compensation, fate of the rental deposit)
- Exit inventory date (scheduled)
- Mutual discharge from future obligations
- Signatures of both parties
- Negotiate conditions: departure date, any compensation, fate of the deposit
- Generate the agreement via our tool by filling in the required information
- Sign the document (handwritten or electronic via itsme/eID)
- Carry out the exit inventory on the agreed date
- Register the agreement at the Legal Security office (recommended)
- Release the rental deposit according to the agreed terms
- Effective date: clearly specify the last day of occupancy
- Rental deposit: state the amount and release conditions (deadline, any deductions)
- Charges: plan for the final settlement of charges and provisions
- Energy: the tenant must take meter readings and transfer contracts
- Registration: without registration, the agreement has no fixed date vis-a-vis third parties
