Essential clauses to check before signing

Before signing a lease in Belgium, each party should carefully review the contract. Here are the priority clauses to verify:

  • Identity of the parties: full name, address, national register number of the landlord and tenant.
  • Property description: exact address, surface area, number of rooms, outbuildings (cellar, garage, garden).
  • Rent amount: monthly rent excluding charges, charge amount (flat-rate or provisional), payment method.
  • Lease duration: 9-year lease (standard), short-term (3 years maximum), or other regime.
  • Termination conditions: notice period, any compensation, grounds for early termination.
  • Indexation clause: reference to the health index, anniversary date for indexation.

Right of reflection and withdrawal
