Student leases in Flanders are governed by the Flemish Housing Decree of 2019 (Vlaamse Woninghuurdecreet), specifically Book 3 dedicated to student housing. This regional legislation replaced the earlier federal rules and provides stronger protection for student tenants. The decree applies to any lease where the tenant is enrolled in a recognised educational institution and uses the property as their student accommodation. Both Belgian and international students studying at Flemish universities, colleges, or other recognised institutions can benefit from these protections. The lease must explicitly state that it concerns student housing to fall under this regime. Landlords renting to students in Flanders must comply with minimum quality standards set by the Flemish housing code, and the property must have a conformity certificate (conformiteitsattest) in certain municipalities.

A student lease in Flanders has a maximum duration of 12 months. Unlike standard residential leases, there is no tacit renewal: the contract automatically ends at the agreed date without either party needing to give notice. If both parties wish to continue, a new lease must be signed explicitly. The starting and ending dates are flexible and can be adapted to the academic calendar. This system gives landlords certainty about property availability while providing students with a clear, limited commitment. If a lease is concluded for longer than 12 months or if the student remains in the property after the end date without a new contract, the standard residential lease rules may apply instead. The lease must be registered with the FPS Finance within two months of signing, free of charge for the tenant.

The Flemish decree grants students three specific early termination rights. First, before the lease starts, the student may cancel with 2 months’ rent as compensation. Second, if the student ceases or does not begin their studies, they can terminate with 2 months’ notice, providing proof of de-enrolment. Third, if a parent or guarantor dies, the student can end the lease with 2 months’ notice. The landlord also has a limited termination right: if the property is needed for personal use or major renovation, the landlord may terminate with 3 months’ notice at the end of the first semester. No compensation is due from the landlord in this case, but strict conditions apply. These provisions ensure students are not locked into housing they cannot afford or no longer need, which is particularly important for international students whose plans may change.

The rental deposit for a student lease in Flanders is capped at 2 months’ rent. It must be placed on a blocked bank account in the tenant’s name, and interest accrues to the tenant. A detailed inventory of fixtures (plaatsbeschrijving) must be completed at move-in and move-out, either jointly or by an expert. The landlord is responsible for structural repairs, while the student handles minor day-to-day maintenance. Utility costs and charges must be clearly specified in the lease: either as a fixed amount or based on actual consumption. For international students, it is advisable to arrange the blocked account as early as possible since Belgian banks may require additional documentation for non-residents. The landlord may not charge the student for lease registration costs, as registration is free for residential leases in Belgium.
