Rules for selling a tenanted property

Selling a property with a tenant is governed by Belgian tenancy law:

Procedure for selling a tenanted property

  1. Prepare the file: lease, rent history, inventory of fixtures, EPC certificate, rental deposit statement
  2. Inform the tenant: courtesy and cooperation for viewings
  3. Organise viewings: respect the tenant’s right to privacy (reasonable hours, prior notice)
  4. Sign the preliminary agreement: mention the existing lease, its duration and conditions
  5. Notarial deed: automatic transfer of the lease and rental deposit

[!important] Legal point The seller must inform the buyer of the existence of the lease. Failure to disclose may constitute a defect of consent and engage the seller’s liability.

The taxation of capital gains depends on the holding period: full exemption after 5 years as an individual.
