Smoke detectors in rental properties: obligation in Belgium

Are smoke detectors mandatory in rental properties in Belgium? Rules by Region, number, placement, maintenance and landlord liability.

Smoke detectors are mandatory in every dwelling let in Belgium. The three Regions have adopted this obligation, with some nuances:

The obligation applies to all types of leases: primary residence, student, short-term, furnished. Installation is at the landlord’s expense. The tenant is responsible for routine maintenance (monthly test, battery replacement).

The absence of a smoke detector constitutes a housing compliance defect. In Wallonia, it is a criterion checked when issuing the rental permit.

Avoid locations near a source of steam (kitchen, bathroom) or a draught (window, ventilation). A poorly placed detector generates false alarms and will likely be deactivated by the tenant.

For a rental property, the optical detector with a 10-year lithium battery offers the best value for money. No battery replacement needed, which eliminates the risk of a negligent tenant.

Detectors must comply with standard EN 14604 and carry the CE marking. Avoid budget models without certification.

Mention the maintenance obligation in the lease and in the property inventory (number and location of detectors). A tenant who deactivates a detector incurs liability.

In the event of a loss, the fire insurance may reduce compensation if detectors were absent or non-functional. This is a risk for the landlord (missing detector) as well as for the tenant (deactivated detector).

Record installation dates in your rental management software and schedule replacement 10 years later.
