Smoke detectors in rental properties: obligation in Belgium
Are smoke detectors mandatory in rental properties in Belgium? Rules by Region, number, placement, maintenance and landlord liability.
Legal obligation in the three Regions
Smoke detectors are mandatory in every dwelling let in Belgium. The three Regions have adopted this obligation, with some nuances:
| Region | Obligation | Legal basis |
|---|---|---|
| Brussels | Min. 1 per floor | Brussels Housing Code |
| Wallonia | Min. 1 per floor + hallways | Walloon Sustainable Housing Code |
| Flanders | 1 per sleeping area + corridors | Vlaamse Wooncode |
The obligation applies to all types of leases: primary residence, student, short-term, furnished. Installation is at the landlord’s expense. The tenant is responsible for routine maintenance (monthly test, battery replacement).
The absence of a smoke detector constitutes a housing compliance defect. In Wallonia, it is a criterion checked when issuing the rental permit.
Number and placement of detectors
Minimum number
| Type of dwelling | Minimum number | Placement |
|---|---|---|
| Studio | 1 | Main room |
| 1-floor apartment | 1 - 2 | Hall + bedroom |
| 2-floor apartment | 2 - 3 | 1 per floor + bedroom |
| Single-family house | 3 - 5 | 1 per floor + bedrooms |
Optimal placement
| Location | Recommendation |
|---|---|
| Ceiling (centre of the room) | Ideal — smoke rises |
| Wall (15-30 cm from ceiling) | Acceptable if ceiling is not possible |
| Bedroom corridor | Mandatory (night alert) |
| Stairwell | Mandatory (1 per landing) |
| Kitchen | Heat detector (avoids false alarms) |
| Bathroom | Not recommended (humidity) |
Avoid locations near a source of steam (kitchen, bathroom) or a draught (window, ventilation). A poorly placed detector generates false alarms and will likely be deactivated by the tenant.
Choosing the detector
| Type | Advantages | Price | Lifespan |
|---|---|---|---|
| Optical (battery) | Simple, affordable | EUR 10 - 25 | 10 years |
| Optical (10-year lithium battery) | No battery replacement | EUR 20 - 40 | 10 years |
| Optical (wired + backup battery) | More reliable, interconnectable | EUR 30 - 60 | 10 years |
| Interconnected (wireless) | Alert in all rooms | EUR 40 - 80 | 10 years |
For a rental property, the optical detector with a 10-year lithium battery offers the best value for money. No battery replacement needed, which eliminates the risk of a negligent tenant.
Detectors must comply with standard EN 14604 and carry the CE marking. Avoid budget models without certification.
Maintenance and replacement
| Action | Responsible | Frequency |
|---|---|---|
| Installation | Landlord | Before letting |
| Monthly test (test button) | Tenant | Monthly |
| Dusting | Tenant | Every 6 months |
| Battery replacement | Tenant | Depends on model |
| Detector replacement (end of life) | Landlord | Every 10 years |
Mention the maintenance obligation in the lease and in the property inventory (number and location of detectors). A tenant who deactivates a detector incurs liability.
In the event of a loss, the fire insurance may reduce compensation if detectors were absent or non-functional. This is a risk for the landlord (missing detector) as well as for the tenant (deactivated detector).
Record installation dates in your rental management software and schedule replacement 10 years later.
