Listed heritage rental property: landlord's obligations
Your rental property is heritage-listed in Belgium. Conservation obligations, works subject to authorisation, impact on rent and available grants.
What heritage listing entails
Heritage listing of a property (classification decree issued by the Region) imposes conservation obligations on the landlord:
- Maintain the property in its original state (facades, roofs, decorative elements)
- Request prior authorisation for any work modifying the property’s appearance
- Allow heritage officers access for inspections
- Not deteriorate the listed elements
Heritage listing does not target modern comfort but architectural preservation. It is often a delicate balance between conservation and habitability, especially for rentals.
Jean-Claude owns an apartment in an Art Nouveau building in Brussels. The original windows (single glazing) are in good aesthetic condition but disastrous in terms of energy performance. He cannot replace them with standard double glazing without authorisation.
The tenant must be informed of the listing before signing the lease. The resulting restrictions (prohibited works, aesthetic constraints) must appear in the lease or its annexes.

Authorisation procedure
- Submit an application to the Heritage Directorate of your Region
- Attach plans, photos, quotations and works description
- Await the commission’s opinion (timeline: 2 to 6 months)
- If authorised: carry out the works in accordance with the authorisation
- Post-works inspection (if applicable)
The authorisation timeline is the main obstacle for the landlord. Jean-Claude must allow 3 to 6 months of procedure before he can intervene on the windows.

EPC and heritage: the dilemma
Listed properties often have a poor EPC score (E, F, G) because the most effective energy improvement works (external insulation, window replacement) require authorisation and are sometimes refused.
