The mechanism of parental surety
A parental surety is a commitment by which parents (or a third party) become joint guarantors of the student tenant’s obligations. If the student fails to pay rent or causes damage, the parents must pay on the student’s behalf.
It is a contract ancillary to the lease, formalised in writing. The surety can be:
- Joint and several: the landlord can claim directly from the parents without first pursuing the student
- Simple: the landlord must first attempt recovery from the student before turning to the parents
In practice, landlords almost systematically require a joint and several surety, which offers maximum protection.

Commitment
The surety covers all lease obligations, not just the rent. The parents commit for:
- The full duration of the lease (including any renewals)
- A potentially unlimited amount (unless a cap is specified)
Parents should carefully read the surety clause. Check whether it is joint or simple, whether it is capped, and whether it covers lease renewals. An uncapped commitment can represent thousands of euros.
Limits and protections
What the landlord CANNOT require
- A surety and a rental deposit exceeding 2-3 months (the surety is additional)
- A surety from multiple persons (a single guarantor is sufficient)
- Excessive financial documents from the parents (only proof of adequate income is reasonable)
Protections for guarantor parents
- The surety can only cover obligations under the lease (not the student’s personal debts)
- If the lease is amended (rent increase by addendum), the surety does not cover the additional amount without explicit consent
- The guarantor may request a discharge by addendum if the student has sufficient income
End of the surety
The surety ends:
- At the end of the lease (after the move-out property inventory and final settlement)
- By written agreement between the parties (discharge addendum)
- By court decision (if the surety is deemed abusive)

- Negotiate a cap: limit your commitment to a specific amount (e.g. 12 months of rent)
