Minimum 9 years, renewable up to 36 years
A commercial lease in Belgium has a statutory minimum duration of 9 years under the Act of 30 April 1951. The tenant can request up to 3 renewals of 9 years each, for a maximum of 36 years. The tenant can terminate at the end of each triennial period (3, 6, 9 years) with 6 months’ notice.
The 9-year minimum is a mandatory provision (d’ordre public). Any clause providing for a shorter duration is null and void, and the lease will be treated as if it were for 9 years. The parties may, however, agree on a longer initial duration (e.g., 12 or 18 years).
The pop-up lease is a recent exception that allows commercial leases of less than one year for temporary commercial activities.
Renewal rights
The commercial tenant has a legal right to request renewal of the lease, up to 3 times:

The renewal request must be sent by registered letter between 18 and 15 months before the lease expires. The landlord has 3 months to respond. If the landlord refuses the renewal, an eviction indemnity may be due.
Missing the 18-15 month renewal window means the tenant loses the right to renewal. After the 3rd renewal (36 years total), no further renewal right exists.
Termination during the lease
By the tenant
The tenant can terminate the commercial lease at the end of each triennial period (after 3, 6, or 9 years) with 6 months’ notice by registered letter. No indemnity is due for triennial termination.
By the landlord
The landlord’s termination options are very limited:
- Personal occupation: possible at the end of each triennial period with 6 months’ notice
- Reconstruction/major works: possible at the end of each triennial period with 6 months’ notice and planning permits
- Serious breach by tenant: court-ordered termination
