Yes, electronic signatures are fully legal in Belgium
Electronic signatures have full legal value in Belgium under the eIDAS Regulation (EU) 910/2014. A qualified electronic signature (created via Belgian eID or itsme) has the same legal effect as a handwritten signature. It cannot be denied legal effect solely because it is in electronic form.
The legal framework for electronic signatures in Belgium rests on two pillars: the EU eIDAS Regulation (directly applicable since 2016) and the Belgian Law of 21 July 2016 (also known as the Digital Act), which complements the regulation at national level.
Under this framework, no contract can be considered invalid solely because it was signed electronically. This applies to all types of contracts, including lease agreements for residential and commercial properties.
The question of whether electronic signatures are specifically legal for Belgian leases is closely related and the answer is equally affirmative.
Three levels of electronic signature
The eIDAS Regulation defines three levels of electronic signature, each with increasing security:
| Level | Description | Examples | Legal value |
|---|---|---|---|
| Simple | Any electronic data attached to a document | Typing your name, clicking “I agree” | Valid but weak evidence |
| Advanced | Uniquely linked to the signer, under their sole control | DocuSign, Adobe Sign (with verification) | Valid with stronger evidence |
| Qualified | Created with a qualified certificate on a secure device | Belgian eID, itsme | Equal to handwritten signature |
Simple signatures are easy to create but difficult to prove in court. Advanced signatures provide good security with identity verification. Qualified signatures offer the highest level of legal certainty and are presumed valid.
BailBelgique uses qualified electronic signatures via itsme or Belgian eID for lease signing. This provides the highest level of legal certainty and is accepted by the Justice of the Peace without question.
Which signature level for a Belgian lease
For a Belgian lease, the recommended signature level depends on the context:
| Situation | Recommended level | Reason |
|---|---|---|
| Primary residence lease | Qualified (eID/itsme) | Maximum legal certainty, accepted for registration |
| Student lease | Advanced or Qualified | Sufficient for most situations |
| Commercial lease | Qualified | High-value contract, enforceability important |
| Lease amendment | Advanced or Qualified | Should match original lease level |
| Inventory of fixtures | Advanced | Acceptable for this annex |
A qualified electronic signature eliminates the need for multiple paper originals — a single digital original suffices. The signed PDF can be uploaded directly to MyRent for registration.
A simple electronic signature (typing your name in an email, for example) is technically valid but very difficult to enforce in court. For a lease — which is a significant legal commitment — always use at least an advanced electronic signature, and ideally a qualified one. The small additional effort provides vastly superior legal protection.
Regional specifics
Brussels-Capital Region
Brussels fully accepts electronically signed leases for registration and legal proceedings. The Brussels Housing Code does not impose specific requirements beyond the federal framework and the eIDAS Regulation.
Wallonia
Wallonia accepts electronic signatures for all lease-related purposes. The Walloon Residential Lease Decree does not add regional requirements. Walloon courts and the FPS Finance accept electronically signed documents.
Flanders
Flanders has been progressive in accepting digital documents. The Flemish Housing Rental Decree fully supports electronic lease signing. Flemish courts accept qualified electronic signatures as equivalent to handwritten signatures.
