Digital inventories are legally valid
Yes. A digital inventory is legally valid in Belgium. The law does not prescribe a specific format — paper or digital both work. Requirements: contradictory (both parties present), sufficiently detailed, and signed by both parties (electronic signatures accepted). Digital inventories offer practical advantages.
Format comparison:
| Aspect | Paper | Digital |
|---|---|---|
| Legal validity | Yes | Yes |
| Photo integration | Difficult | Easy |
| Storage | Physical space needed | Cloud storage |
| Sharing | Copies needed | Instant sharing |
| Search | Manual | Keyword search |
| Modification risk | Lower (originals) | Requires integrity safeguards |
Requirements for validity
For a digital inventory to be legally valid: it must be contradictory, detailed, dated, signed by both parties (electronic signature valid), and accessible to both parties. Use a reliable platform that ensures document integrity and non-repudiation.
Technical requirements:
- Electronic signature: valid under the EU eIDAS Regulation (simple, advanced, or qualified)
- Document integrity: the document must not be modifiable after signature (PDF with signature, blockchain, etc.)
- Date certainty: the document must bear a clear date
- Accessibility: both parties must receive a copy
- Backup: ensure secure storage and backup
A digital inventory completed on a tablet and signed electronically is valid. However, ensure the electronic signature method provides sufficient proof of identity and consent. A simple “I accept” checkbox may have weaker probative value than a qualified electronic signature.
Advantages of digital inventories
Digital inventories offer several practical advantages:
- Integrated photos: embed dated, high-resolution photos directly in the document
- Easy comparison: side-by-side comparison of entry and exit inventories
- Cloud storage: accessible from anywhere, no risk of physical loss
- Sharing: instant sharing with tenant, landlord, expert, insurance
- Templates: standardised formats ensure completeness
- Timestamps: automatic dating and logging of changes
Several specialised platforms and applications offer digital inventory solutions for the Belgian rental market. These often include standardised room templates, photo integration, and electronic signature functionality.
