Paper lease vs digital lease: pros and cons

Why the lease format matters
In Belgium, over 1.5 million properties are rented on the private market. Every year, hundreds of thousands of leases are signed, renewed or amended. Yet a large proportion of landlords continue to draft their contract on a pre-printed form bought from a stationery shop, without questioning the format.
The choice between paper and digital lease is not trivial. It impacts the speed of contract conclusion, the ease of registration with the FPS Finance, the security of archiving and the ability to manage your rental portfolio efficiently. Belgian law does not impose any particular format for the primary residence lease. A handwritten, typed or digital contract has the same value, provided it respects the mandatory mentions required by regional legislation.
Legal validity: what the law says
The eIDAS regulation
Since 2016, the European eIDAS regulation (No. 910/2014) harmonises the recognition of electronic signatures across the European Union. It distinguishes three levels:

For a primary residence lease, an advanced electronic signature is the recommended minimum. A qualified signature (via Belgian eID or itsme) offers maximum security and cannot be contested before the justice of the peace.
Regional annexes
Each region requires specific annexes to the lease. In Brussels, the indicative rent grid and the explanatory annex on rights and obligations must be attached. In Wallonia, the standard lease annex is mandatory. In Flanders, the Vlaams Woninghuurdecreet has its own provisions. These annexes can be integrated into the digital PDF document, which simplifies management.

Advantages of paper
The paper lease remains relevant for landlords who rent a single property and do not wish to use digital tools. It requires no technical skills and can be signed immediately during the property viewing. Some older tenants are also more comfortable with a physical document.
Advantages of digital
The digital lease comes into its own when you manage multiple properties. Document centralisation, automated reminders (indexation, deadlines, EPC renewal) and remote signing represent considerable time savings. Digital archiving eliminates the risk of loss and facilitates transmission in the event of a tax audit.
Even if you choose paper, systematically scan your signed lease and store the digital copy in a secure space. You will then have a backup in the event of a disaster (fire, water damage).
FPS registration: paper and digital accepted
Lease registration is mandatory and free for primary residence leases. The landlord has two months after signing to register the contract. In the event of a delay, it is the landlord who bears the consequences (the tenant can terminate the lease without notice or compensation).

How to choose between paper and digital
The choice depends on your profile and management volume:
- 1 property, stable tenant: paper suffices, provided you respect the registration deadlines and keep the document in a safe place.
- 2 to 5 properties: digital becomes a major asset for centralising leases, automating reminders and saving time on administration.
- More than 5 properties: digital is virtually indispensable. Paper management of multiple leases, addenda, indexations and EPC renewals quickly becomes unmanageable.
In all cases, the digital lease does not replace rigour: the mandatory mentions, regional annexes and FPS registration remain identical regardless of format. What changes is the efficiency with which you manage them.
