Who can give notice?
Lease termination by the tenant is a right granted to every tenant in Belgium. Any tenant who has signed a primary residence lease may give notice. This termination is free of justification — no reason needs to be given. It applies to single tenants, co-tenants, and commercial lease tenants (subject to their own rules).
The termination must comply with three rules: written form, legal notice period, and any applicable compensation.
Notice period by lease type
The notice period varies depending on the type of contract signed.
Primary residence lease (9 years)
- 3 months’ notice, at any time.
- Decreasing compensation during the first 3 years: 3, 2, or 1 months’ rent.
- No compensation from year 4 onwards.
Short-term lease (3 years or less)
- 3 months’ notice, possible at any time.
- Reduced compensation: 1.5 / 1 / 0.5 months’ rent depending on the year.
Fixed-term contract
A fixed-term contract (such as a student lease or a lease with a set end date) follows specific rules. The tenant must check the specific clause in the contract, give the stipulated notice (often 2 or 3 months), and pay any contractual compensation.
In the absence of a specific clause, the default rules of the primary residence lease apply.
How to calculate your notice period
The notice period begins on the 1st day of the month following receipt of the registered letter. Example: letter sent on 10 March, received on 13 March, notice starts 1 April, lease ends 30 June (3-month notice).
The effective end date determines the date of the exit inventory. Rent continues to be due until that date. The lease signing date is the reference for calculating any compensation.
Step-by-step procedure
For a termination without dispute, follow 5 steps.
1. Check your contract
Re-read the lease: duration, signing date, termination clauses, reference rent amount.
2. Calculate notice and compensation
3 months’ notice for standard leases. Compensation is calculated on the current indexed rent.
3. Draft the letter
A formal letter: identities, address, lease reference, desired end date, grounds if required, signature.
4. Send by registered post
Registered letter with acknowledgement of receipt (paper or electronic). A simple email is not sufficient, unless the contract provides otherwise.
5. Organise departure
Exit inventory, proof of receipt kept safely, final month’s rent paid, key handover, return of the rental deposit.
Early termination by mutual agreement
The tenant and landlord may agree on a termination by mutual consent. This option allows shortening the notice period, waiving compensation, and setting an earlier end date.
The agreement must be in writing and signed by both parties. This solution is often used when a replacement tenant is quickly found. Mutual agreement is recommended when relations are good. It avoids sending a registered letter and any potential tension.
Special cases
Unregistered lease
If the lease is not registered with the FPS Finance, the tenant may terminate without notice or compensation. This is a strong tenant protection. A landlord who has not registered the lease loses their rights.
Death of the tenant
In the event of death, the heirs may terminate the lease with 2 months’ notice.
Force majeure
A situation of force majeure (flooding rendering the property uninhabitable, expropriation) may end the lease immediately, without notice or compensation.

- Lease type identified (primary residence, short-term, fixed-term).

- Letter containing all mandatory information.
- End date consistent with the notice period.
