The foreign student rental market in Belgium

Belgium welcomes over 70,000 foreign students each year, the majority concentrated in university cities (Brussels, Leuven, Ghent, Liege, Louvain-la-Neuve). This market represents a significant opportunity for landlords: strong demand, stable rents and predictable turnover.

But renting to a foreign student carries specific risks:

  • No local guarantor: the parents live abroad
  • Recovery difficulty: if the student leaves the country
  • Ignorance of Belgian law: the student does not know their obligations
  • Language barrier: the lease must be understandable
Non-discrimination

The landlord cannot refuse a tenant on the grounds of nationality or origin. The anti-discrimination law of 10 May 2007 prohibits any distinction based on nationality. However, requiring enhanced financial guarantees for any tenant without income in Belgium is legal.

Documents to require before signing

Identity documents

  • Enrolment certificate from the Belgian educational institution

Financial documents

  • Proof of solvency: scholarship certificate, parents’ bank statement, student employment contract
  • Guarantor commitment (joint surety) signed by a parent or guardian
  • If guarantor abroad: apostille or legalisation of signature (Hague Convention)

Only keep documents strictly necessary for the rental. Passport copies must be stored securely and deleted at the end of the lease. Excessive collection of personal data is sanctioned under the GDPR.

Securing the rental deposit

The standard bank deposit

The foreign student can open a Belgian bank account and deposit the rental guarantee. Most Belgian banks (BNP Paribas Fortis, ING, KBC) offer student accounts with an integrated rental deposit account.

Advance payment

If the student cannot open a Belgian account before arrival, an alternative is advance payment by international transfer. The landlord then places the sum in a blocked account.

The overseas guarantor

A parent can act as guarantor from abroad. The surety commitment must be:

  • Drafted in French (or in the language of the lease)
  • Signed and legalised (Hague apostille for signatory countries)
  • Unlimited or capped at a specific amount

Double security

The safest combination: 2-3 months’ rental deposit in a blocked account + overseas guarantor. If the student leaves Belgium without paying, the deposit covers the first months and the guarantor covers the balance.

Day-to-day practical management

The accommodation declaration

The landlord must report the arrival of a foreign tenant to the municipality within 8 days. This obligation applies to all non-Belgian tenants, including EU nationals. The form is available at the municipality or online depending on the municipality.

Communication

Draft the lease in the language of the region (French in Brussels and Wallonia, Dutch in Flanders) but provide an informative English version. The legally binding document is the one in the official language.

End of lease

The main risk is the student leaving without a move-out inventory. To prevent this:

  1. Contact the student 2 months before the lease end to set the inventory date
  2. Schedule the move-out inventory on the day of key handover
  3. Process the deposit release promptly to avoid remote disputes
  4. Keep the guarantor’s contact details for potential recovery

Unpaid rent insurance

Some insurers offer “unpaid rent” cover protecting the landlord against payment default. The cost is 2 to 3.5% of the annual rent. For foreign students without income in Belgium, this insurance is a recommended safety net.

Frequently asked questions

  • Yes, you can request a guarantor (joint surety), but you cannot require the guarantor to reside in Belgium. An overseas guarantor is legally valid, but enforcement in the event of default is more complex. The safest solution is to request an advance payment of the rental deposit (2 months in Brussels/Wallonia, 3 months in Flanders) or 3 to 6 months' advance rent payment.

  • Yes. Any non-Belgian student staying in Belgium for more than 3 months must register with the foreigners' register of their municipality.
